US ARMY VETERAN SUFFERS SPINAL INJURY AT WINN DIXIE GROCERY STORE IN MIAMI, FL.

It has been 22 months; Winn Dixie denies paying claims and has hired a law firm COLE, SCOTT & KISSANE P.A. with over 200 attorneys and paralegals to fight against Roberto Naranjo a disabled United States army veteran with honorable discharge with a NATIONAL DEFENSE SERVICE MEDAL, and a good standing citizen.

Naranjo a successful insurance and financial advisor states in June 2009, โ€œI had a disectamy and laminoctamy that took the pain away but left him with a spinal fluid leak scar with no pain. I was walking 2-5 miles a day without a walker, swimming, cooking and driving without any pain. I was on my way to the American dream โ€“ till the accident at Winn Dixie.โ€

Mr. Naranjo tried to address the problem to the CEO of Winn Dixie and his staff and they turned around and offered him $500 for a Parking Lot Accident that has left him permanently disabled. Mr. Naranjo hired a lawyer that promised him neurosurgeons. He gave Mr. Naranjo two to choose from. One from Aventura Florida, and the other from Trinidad & Tobago that lived in Miami. Attorney stated it would cost him $1000 out of pocket.

Mr. Naranjo said, I will try some conservative approaches to this injury and in two months if pain continues, I will be ready to meet with neurologists about possible surgery to stop this burning pain.

Naranjo was ready to see neurosurgeon and lawyer who would not return his calls. Attorneyโ€™s legal assistant was uneducated about the details of Mr. Naranjoโ€™s case. The receptionist kept telling him that the lawyer and the receptionist were not available for weeks at a time. Due to his injury he could not drive over to get his medical records. He tried to do this through e mail communication and the receptionist kept ignoring it until one day she told him exactly what to put in the email so she wouldn't have any liabilities, and was able to also put a lean on his case.

After finally firing the lawyer and getting his medical records back, he called Winn Dixie again to give them a second opportunity and emailed Winn Dixie to see if there's any way they will help him with medical bills and they offered $3000. He said, he thought they should be in jail for $3000 offered for a spinal injury.

Mr. Naranjo was in such pain that permanent damage was setting in. So he went to second lawyer. The new lawyer spent 3 minutes on interview but Mr. Naranjo was able to explain to him that pain and suffering from injury and professional malpractice from previous lawyer. The new lawyer said to him, how did you get my name? I said โ€œyellow pages.โ€ He said โ€œyou are lucky to have him because I am the best lawyer against Winn Dixie.โ€

His paralegal sent him an email a week later telling him that she will file the lawsuit tomorrow and I replied saying โ€œthank you very much and you are a life saver.โ€ I continued to go to the hospital but having a previous back surgery I knew this was a serious injury and time was not on my side. And to be sure my second attorney was on the right track I asked him if I could have a copy of the lawsuit. He called him a week later and said if I call his office again, he would not represent him anymore.

He was in such pain that the last thing he wanted was not to have an attorney, because that was a way to see the Judge to help save my life. Soon after that his injury has deteriorated so bad that he was having convulsions and shakes that emergency room and ambulance transport was unavoidable.

Once the emergency room was sending him home in a van with stretcher he felt like his life was coming to an end, he started to look for ways to save my life so he decided to go to a hospital in Boston because he was denied surgery in Miami due to his complaint against the neurologist at the hospital. So on his next trip to the ER he took advantage of the morphine shot, jumped on a plane with his walker and landed in Boston Massachusetts.

While registering at the ER in the hospital, they asked him for my address. I answered that I don't have an address because when I became paralyzed I gave away my car, my furniture, my TV and personal items because I became homeless on my way to Boston. I later found out that a homeless person would have a hard time getting a neurosurgeon to do surgery on him if he has no place to recover. ER doctor said all you people from Miami come here for surgery and end up in a homeless shelter (that is not why I went to Boston) especially being from Florida dipping into their Massachusetts budget for their own residents.

I was hospitalized in Boston for 21 days. Fell down twice in the hospital and had called 9 11 for help because nurses would not come to my aid. They refused to put a trapeze bar over my bed until I fell down. Now I'm scared of the hospital and also in a lot of pain. I called Senator Scott Brown's office, they said not to leave the hospital but when they started over medicating him and rationing the water I had no choice but to fly back to Miami.

Mr. Naranjo had no choice but to come back to Miami because he didn't know anyone in Boston. He checked in to the closest hotel to the airport in Miami exhausting all his (my) money. I called the attorney that told him never to call his office, because of my desperate situation and he said that my case was too complicated and I need to find another attorney because he didn't have the time to spend on one client, he said he had too many clients but continues to advertized

Mr. Naranjo's 2nd attorney had concealed information about Mr. Naranjoโ€™s case that could have prevented Mr. Naranjo from flying to Boston and losing all his furniture and automobile and taking plan B which was morphine regiment in an assisted living in Florida because I knew that being in front of the Judge or the jury the solution to my medical problems would begin.

Mr. Naranjo called Winn Dixie again to inform them that the second lawyer was too busy to help him and he tried emails and calls to Winn Dixie but they would not return his calls. So he started to call other lawyers not now knowing that his case was in was in the court system because second lawyer had concealed information and not sent him proof of a law suit.

So it became impossible to find a 3rd lawyer, and after months of calling and sending e mails to Winn Dixie and their lawyers at COLE, SCOTT & KISSANE P.A. they continued to play games and avoid paying the claims.

After finally calling Winn Dixie's lawyerโ€™s at COLE, SCOTT & KISSANE P.A and getting a hold of them they said to him โ€œif you want to settle this case you must go to the court house and tell the Judge that you want to represent yourself. Then do the deposition we will settle with you.โ€

They made it sound as thought it would be something simple. So Mr. Naranjo went to meet the Judge and a new attorney Krystina Machado from COLE, SCOTT & KISSANE P.A showed up instead, so we went to see the Judge.

Then he sat in front of the Judge and was told he'd have 5 minutes to speak. As he was speaking the Judge stopped him and looked at the defense lawyer from COLE, SCOTT & KISSANE P.A and said โ€œyou understand this guy cannot represent himself and you are a big law firm like COLE, SCOTT & KISSANE P.A. in the state of Florida and this guy doesn't really have a chance against your law firm so your plan is to do the deposition and then settle with him correct?โ€ The defense lawyer from COLE, SCOTT & KISSANE P.A. said yes and at the same time she sent him unexpected questions and answers that a lawyer would get 30 days to answer, but him, the injured victim only got 10 days to answer them. So he did that, and requested a deposition immediately, they delayed it months because they were too busy. He repeatedly told them that his life was in danger and they kept ignoring it because they were too busy.

After that he answered all the questions in the 10 day period and he went to the deposition.

He answered all the questions the best of my knowledge truly and correct but I was in so much pain during the deposition that they kept him upset most of the time by not letting him finish answering the way a normal person would answer.

After 22 months of constant pain, depression, my speech was not connecting with my brain properly. The defense lawyers from COLE, SCOTT & KISSANE P.A Sheila M. Gonzales-Jonasz knew that but they continued to abuse him. It's been over a week since the deposition and no sign of a settlement and they know Mr. Naranjoโ€™s life is at risk everyday that he is homeless without medical treatment, next to his walker trying to live another day.

He recently went to Salvation Army for shelter but they turned him down because of his injury and he used a walker. His injury at Winn Dixie stores is now being decided by lawyers at COLE, SCOTT & KISSANE P.A, who care less about him.

The problem with this story is that Mr. Naranjo is dying and Winn Dixie prefers to pay a big law firms like COLE, SCOTT & KISSANE P.A. Than to help his customers, and pay for his medical treatment, personal losses, pain and suffering with early death from an unavoidable hole that was impossible to see at the exit of the store

What happen to โ€œCustomer is always firstโ€ mentality

I am sure that CEO's are making millions; some of their customers are dying from store accidents so the law firm's like COLE, SCOTT & KISSANE P.A get rich and their client dies. These actions by CEOโ€™s and defense lawyers like COLE, SCOTT & KISSANE P.A. should be investigated by the State Attorneyโ€™s Office, and Florida Bar. Also any help from newspapers that would like to publicize this news segment, local or national news, starting in Miami then Jacksonville Florida, working our way to all the states where Winn Dixie does business.

Mr. Naranjo now has permanent leg and back damage and uses a walker, has no family and has not fulfilled his American dream, he just wants to work but he canโ€™t.

Yeah..just because you had an accident on their property, doesn't make them responsible. Someone is obviously looking for some easy settlement cash. Shame.
